Here are our terms of sale. By ordering, you agree to the following.
PRICES & WORK COMPLETED:
For installations, you are paying for our time. Prices listed at the DesignExtend.com site and store include only the exclaimed work, and do not provide for additional customization without incurring a separate cost or hourly rate. MSI and DesignExtend.com will support its work for an unlimited time so long as no other factors interfere (such as upgrades, other developer work or elimination of files). Customizaton errors or loss by no fault of MSI will incur full charges for re-customization.
CUSTOMER SUPPORT:
Anyone purchasing any standalone products (except for the previously sold CIM Tool Kit) will receive customer support on installation and use. Support is handled through our online support & request desk. Telephone support is available to retainer clients or on a pay-per-incident basis. Support does not include us accessing your store or site - which will be charged at the same rate as installation. For customizations only, issues shall be directed to our sales staff.
PURCHASES OF MODULES, SOFTWARE, DOCS & APPLICATIONS:
All software (module) sales are considered non-returnable. In some circumstances a credit or coupon may be issued. Such exchanges or returns are made on a case-by-case basis, and customers must first contact us either by email or phone, and, if a return is accepted, provide us with proper documentation as requested.
Additional Terms Apply:
- If a customer purchases the wrong version of a product, the customer must purchase the correct version. Once the correct version is delivered, a store credit for the full price of the incorrect version will be issued.
- Acceptance of returns will be reimbursed with a store credit for another purchase.
- In the event that a monetary credit is deemed necessary, a 10% restock fee will be applied.
LICENSE AGREEMENT:
Each product listed in the DesignExtend.com has licensing terms. While each may vary, all modules carry similarities, in that:
The module is copyrighted and you cannot resell or transfer your license of the module to other individuals or companies. Since your payment is for a license to use the item, it is registered to you for use on the domain your provide to us. Should your domain change, please notify us so we may update our records. Use of the module constitutes your acceptance of the terms set forth with each product.
ADDITIONAL COPYRIGHT INFO: Any of the customization work performed by MSI and DesignExtend.com is not work-for-hire. At all times, either the company or developer or designers holds their copyrights. Should you require to obtain the copyright, agreements must be set forth in writing and usually will carry an additional cost. We rarely transfer the copyright of any modules, software or custom coding, designs and custom HTML.
YOUR OWN RISK:
MSI shall not be held liable for any damage occurring from installing and/or using our products and services. No guarantee can be made as to a module being bug-proof, and the purchaser shall not hold us responsible for loss of time or data due to proper or improper usage of any products or services purchased from us. While every step is taken to ensure usage is smooth and without problems, like all software, modules and custom code are dependent on various factors, including server and store configurations.
METHODS OF PAYMENT:
We accept MasterCard, Visa, American Express, Discover Card, and PayPal for online purchases. You may also pay by check, money order or bank wire. Products and services will not be delivered or performed until funds are cleared.
Payments made via PayPal must include a valid shipping address in order for us to obtain seller protection. Non-validated addresses or blank addresses may result in a rejection of funds. PayPal payments made via check or credit card that have "clearing delays" will result in a delay in product delivery, as we will not fulfill orders until funds have cleared.
Only the cardholder may order and license any software, product or customization, as required by law, except for those paying via a Designer Key. By placing an order, you attest that you are the cardholder AND the licensee and that you either own or have authorization to install or use the product(s) in regard to the domain for which you are licensing the modules under.
THIRD-PARTY PURCHASES:
MSI and DesignExtend.com hold partnerships with various third-parties. When the shopper is directed to another site for purchase, we will not be held responsible for any issue surrounding such. If you believe one of our partners is unethical, please contact us.
PRIVACY ISSUES: MSI and DesignExtend.com respect client privacy and take every step to maintain confidentiality in the highest degree. We will not discuss your business or access issues with any other parties. If you require a confidentiality agreement, please e-mail us.
